WILLEM BARENTSZ BARTENDER COMPETITION WITH BARLIFE

TERMS AND CONDITIONS

Bartenders will be deemed to have accepted these terms and conditions (“Terms and Conditions”), and agreed to be bound by them, when entering this Promotion. The Promoter reserves the right to amend these Terms and Conditions at any time.

KEY DEFINITIONS AND TERMS:

“PROMOTER” means Willem Barentsz Ltd of 3 Mandeville Place, London, W1U 3AP, United Kingdom

“AGENCY” means Domino Communications Ltd of Highview House, 1st Floor, Tattenham Crescent, Epsom, Surrey, KT18 5QJ who shall be responsible for administrative aspects of the Promotion (including technical support and other support where required), with the assistance of the Media Partner

“MEDIA PARTNER”  means BarLife UK of 30 Boundary Road, London, SW19 2AN

“START DATE” means 11:59pm (UK time) on 10th May 2017

“CLOSING DATE” means 11:59pm (UK time) on 22nd May 2017

“BARTENDER” means an entrant into the Promotion

“PROMOTION” means the competition regulated by these Terms and Conditions

ENTRY PERIOD

Any entries received after the Closing Date will not be considered for inclusion into the Promotion.

WHO MAY ENTER

The Promotion is open to UK-based Bartenders aged 18 or over.

The following may not enter or win a prize: (a) employees of the Promoter or its agents (including the Agency) including any family members and (b) anyone else who is directly or indirectly professionally connected with the Promotion or the Promoter or the Media Partner and/or their family members.

LIMITATIONS / RESTRICTIONS ON ENTRY

One entry into the Promotion per Bartender and a Bartender cannot represent more than one bar.

Incomplete entries and entries that do not comply in full with these Terms and Conditions will be disqualified and will not be counted.

Internet access is required.

HOW TO ENTER

First Round:

Task – creating the ‘Flight of Discovery’ cocktail.

Inviting UK Bartenders shall create a cocktail that embodies their ultimate adventure, this can be a dream destination, once in a lifetime achievement (climbing Everest, walking the Great Wall of China, kite surfing in Cape Verde…skies the limit, literally!)

The cocktail must be invented to include at least 35 mls of Willem Barentsz gin.

Bartenders must provide the following information (“Information”):

(a) tell us what their ultimate flight of discovery is, give a brief overview of the cocktail, its flavour profile and ingredients.

(b) submit a short paragraph explaining their thought process behind the drink including how their dream adventure is integrated into the cocktail.

Short videos are also accepted (provided that they are no longer than a minute in length)

Miniatures of Willem Barentsz gin will be sent out to help create the drink (at the Promoter’s sole discretion).

Entries will be recreated on-site at Willem Barentsz HQ where they will

be judged by Michael Claessens (the brand owner of BarLifeUK), Gin

Monkey (Emma Stokes) and a hand-picked team of industry

heavyweights.

The chosen 6 finalists will be invited to take part in the Flight Club final

in London on the 30th of May, where they will be asked to recreate their

Flight of Discovery cocktails for the judges.

Finalists living outside of London will have their reasonable travel expenses paid to attend the competition.

The Promoter reserves the right to reject entries based on incomplete

Information being provided or inappropriate content / language being used.

Bartenders submitting incomplete or disqualified entries will not be contacted.

FINALIST SELECTION AND NOTIFICATION

Entries will be reviewed by a judging panel including Gin Monkey (Emma Stokes), Willem Barentsz ambassador Jamie Kimber, Willem Barentsz brand owner Michael Claessens and representatives from the Promoter, the Agency and BarLifeUK.

Six finalists (“Finalists”) will be selected from all complete, correct and eligible entries received before the closing date. Finalists’ entries will be determined in the opinion and sole discretion of the judges.

Finalists will be contacted by telephone or email using the details supplied at time of entry within 2 days of the Closing Date.

Bartenders should ensure they check their spam/bulk/junk folders for notification because if a response from a finalist is not received within 5 days of the notification being made, a finalist may lose their place in the live final. Proof of age, identity and eligibility may be required in order to progress to the live final.

Unsuccessful applicants will not be contacted.

FINAL:

Finalists will be asked to create the cocktail at a live final, in London, on the 30th of May 2017 (“Final”)

Finalists will be judged live by an industry panel including Gin Monkey (Emma Stokes), Willem Barentsz ambassador Jamie Kimber, Willem Barentsz, brand owner Michael Claessens and representatives from the Promoter, the Agency and BarLifeUK.

Finalists’ cocktails should not differ from initial entry description, shall contain a minimum 35 mls of Willem Barentsz gin and Finalists shall provide a detailed recipe and method for the chosen cocktail.

The final six Bartenders will be marked on:

(a) Presentation

(b) Balance

(c) Taste

(d) Creativity

(e) How well the drink represents the brief as set out above.

WINNER SELECTION AND NOTIFICATION

The overall competition winner will be announced on the night of the final.

The Promoter’s and judges’ decisions are final and binding in all respects on all Bartenders and no correspondence will be entered into if the winner is disputed.

STANDARDS FOR ENTRIES

The Promoter expressly reserves the right to disallow or disqualify (or prevent from passing through the judging stage) any entry which it considers does not meet normal standards of taste and decency.

PROMOTER’S USE OF CONTENT

By entering the Promotion, Bartenders grant the Promoter, its affiliated companies and its sub-contractors the exclusive assignable royalty free in perpetuity worldwide right to use any and all cocktail entries (”Content”) supplied to the Promoter in connection with the Promotion:

a) for the purposes of administering this Promotion;

b) for promotional and publicity purposes; and

c) in all digital and social media in connection with the Promoter and the Promotion.

To the extent permitted by law, the Bartenders hereby waive in favour of the Promoter any rights they may have to the Content and agree not to assert any moral rights (or similar rights worldwide) in and in connection with their Content.

PRIZE

The 6 Finalists will receive a short profile on the BarLife UK website.

The overall winning drink will be promoted on the Willem Barentsz website and social media channels.

The overall grand prize for the winner is a sky diving flight with the brand owner, Michael Claessens, and further additional activities will be confirmed in due course.

The Prize includes transport to and from the aerodrome.

Certain other reasonably and properly incurred costs and expenses during the Prize trip, such as food and drink and other entertainment, may be paid for by the Promoter at the Promoter’s sole discretion

Other costs, such as personal insurance for the sky dive, personal expenditure and other incidental costs other than those specifically included above or are not reasonably incurred (at the sole discretion of the Promoter) in the course of the Prize trip shall be the responsibility of the winning Bartender.

The Prize trip must be taken by the Bartender on the dates organised by the Promoter (estimated to be between the 16th and 23rd of June 2017). The exact dates of the Prize are to be confirmed pending the availability of the winner and brand owner.

The Promoter reserves the right to substitute the Prize (or any part thereof) for a prize or prizes of equivalent or greater monetary value if this is necessary for any reason at its sole discretion. There is no cash alternative to the Prize (or any part thereof) and unless the Promoter agrees otherwise in writing the Prize is non-refundable and non-transferable.

Details of winners names (if multiple) will be available for one month after the closing date by writing to the Agency at the contact details above and stating the name and date of the Promotion.

LIABILITY AND INDEMNITY

References to the Promoter in this section (Liability and Indemnity) include all of the Promoter’s associated companies, agents or any other third party involved in the Promotion.

In so far as it is able to at law the Promoter shall not bear any responsibility for any damage, loss, death or injury suffered by any Bartender entering the Promotion or as a result of accepting the Prize (of any part thereof) and shall under no circumstances whatsoever be liable to any Bartender, whether in contract, tort (including negligence), breach of statutory duty, or otherwise in connection with any breach of these Terms and Conditions.

For the avoidance of doubt the company or entity that runs the sky dive (as part of the Prize) shall assume all liability for any damage, loss, death or injury suffered in connection with the sky dive by any Bartender to the exclusion of any liability of the Promoter whatsoever.

The Promoter will not be responsible for (and will have no liability in connection with) the following occurrences, to the extent that they occur for reasons beyond the Promoter’s reasonable control:

a) any postponement or cancellation of the Promotion;

b) any changes to the Prize (of any part thereof); and

c) problems with the dispatch of prizes (such as a prize failing to reach the intended recipient)

The Promoter does not accept responsibility for network, computer, hardware or software failures of any kind, which may affect the sending, receipt or processing of your entry or for entries lost, damaged, delayed or become unreadable, including loss of entries through technical fault or transmission delays.

If the Promoter has grounds to suspect any Bartender or third party of cheating, deception or fraudulent or unsportsmanlike conduct of any kind (including, without limitation, manipulating the Promotion, choice of prize winner(s) or any entry (or establishing multiple registrations in order to gain multiple entries where the number of entries is limited)), the Promoter reserves the right (in its sole discretion) to disqualify any Bartender’s entry.

The winner should be in good health and appropriately fit for travel and shall waive any claim they may have against the Promoter for any safety or health issue or problem they may have during travel.

The Bartenders shall indemnity the Promotor against all liabilities, costs, expenses, damages and losses (including but not limited to any direct, or indirect or consequential losses, loss of profit, loss of reputation and all interest, penalties and legal costs (calculated on a full indemnity basis) and all other interest, penalties and legal costs in connection with a breach of these Terms and Conditions.

PERSONAL DETAILS AND PUBLICITY

The Promoter will use the Bartenders personal details for the purpose of administering this Promotion only.

By entering this Promotion, Bartenders agree that if they are a Finalist or the winner they will grant the Promoter the free use of their name, country of residence, photographs, video and voice (“Image”) for advertising, publicity and news purposes in any media in perpetuity without additional remuneration. The winner may also be asked to take part in reasonable publicity and public relations activities in connection with the Promotion, which they shall accept unless it is unreasonable for them to do so.

ENGLISH LAW APPLIES

This Promotion, and any dispute or claim arising out of or in connection with it (including the Prize (of any part thereof), shall be governed by and construed in accordance with English law and Bartenders irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any such dispute or claim.
